Welcome to Linh's Water & General Store. These Terms of Use ("Terms") govern your use of our website at linhswatergeneralstore.com (the "Site") and your visits to and purchases from our physical store located in Gardena, California.

By using the Site or visiting our store, you acknowledge that you have read and agree to be bound by these Terms. In-store policies posted on signage within the physical location supplement these Terms for in-store transactions. Where any conflict exists between these Terms and posted in-store signage, the posted in-store signage governs for in-store transactions.


1. Business Identity

This Site and the Linh's Water & General Store physical location are operated by LINH'S WATER & GENERAL STORE LLC, a California limited liability company. The business operates under the trade name Linh's Water & General Store.


2. Water Refill Services

2.1 Customer Container Responsibility

Customers are solely responsible for the cleanliness, sanitation, and structural integrity of any bottles, jugs, or containers brought in for water refill. By presenting a container for filling, you represent and warrant that it is clean, undamaged, food-safe, and appropriate for the type of water being dispensed.

2.2 Right to Refuse Filling

We reserve the right to decline to fill any container that, in our reasonable judgment, appears visibly contaminated, damaged, structurally compromised, or otherwise unsuitable for filling. Such decisions are made on the basis of legitimate operational and safety concerns, applied consistently and without discrimination.

2.3 Staff Handling of Customer Containers

When a customer requests that store staff physically handle their container to perform a refill, that handling is performed solely at the customer's express request and risk. Our visual inspection is limited to what is reasonably observable to the naked eye and does not constitute a certification of container safety or cleanliness. You assume all liability for any condition of your container not reasonably visible upon inspection.

2.4 Liability After Refill

Once a container has been filled and leaves our facility, the customer assumes sole responsibility for the safe transport, storage, handling, and consumption of the water. We are not liable for any contamination, spoilage, leaks, spills, illness, or other harm that occurs after the filled container leaves our premises.

2.5 Water for Off-Premises Use Only

Water dispensed at our facility is intended for take-home use and off-premises consumption only. We do not provide in-store drinking facilities. Customers are responsible for consuming water within a reasonable time after filling and for maintaining proper storage conditions after leaving the store.

2.6 Water Types and No Medical Claims

We currently offer purified water (processed through reverse osmosis) and alkaline (pH-enhanced) water. Our water is produced and tested in compliance with applicable California Department of Public Health (CDPH) regulations. We make no representation or warranty that our water is fit for any specific medical purpose. Nothing in our product descriptions, signage, or marketing constitutes medical advice. For health-related decisions, consult a qualified healthcare provider.


3. Outdoor Water Vending Machine

An outdoor water vending machine is located at our premises for customer convenience. The following terms apply specifically to the vending machine:

  • The vending machine accepts cash only. Credit cards, digital wallets, and prepaid cards are not accepted at the vending machine.
  • All vending machine transactions are final. No refunds are issued for vending machine purchases.
  • If the machine malfunctions — for example, if payment is accepted but water is not dispensed — please contact us at (310) 878-1156 during business hours. We will make reasonable efforts to address documented malfunction reports. We are not liable for indirect, incidental, or consequential damages arising from vending machine malfunctions.
  • The vending machine is licensed and inspected in accordance with California Department of Public Health requirements. The required CDPH license is posted on the machine.

4. Sales, Refunds, and Payments

4.1 All Sales Final

All sales — including water refills, packaged food and snack items, supplements, water dispensers, bottles, caps, and accessories — are final. We do not offer refunds or exchanges except where required by applicable law. This policy is also posted at our store entrance and point of sale.

4.2 Payment Methods Accepted

We currently accept:

  • Cash
  • Credit and debit cards (contactless/tap via card terminal)
  • Apple Pay
  • Google Pay
  • Samsung Pay
  • Venmo (Business)
  • Zelle

Important note regarding Venmo and Zelle: Payments made via Venmo or Zelle are processed as peer-to-peer transfers. These methods do not provide purchase protection, buyer protection, or transaction dispute services. By choosing to pay via Venmo or Zelle, you acknowledge and accept these limitations.

4.3 Cash Transaction Rounding

Because the U.S. Treasury has ceased production of the one-cent coin, cash transactions are rounded to the nearest $0.05 increment. Rounding may be up or down depending on the total. This applies only to cash payments; all electronic payments are charged the exact amount.

4.4 Prepaid Card Program

We offer a Prepaid Card program allowing customers to pre-purchase water fill credits. Use of a Prepaid Card is governed by our separate Prepaid Card Terms & Conditions, which are incorporated into these Terms by reference. In the event of a conflict between these Terms and the Prepaid Card Terms regarding card use, the Prepaid Card Terms control.


5. Store Operations

5.1 Hours

Store hours are subject to change without notice. Current hours are posted on our Google Business, Yelp, and Apple Maps listings. We are not responsible for inconvenience caused by outdated hours reflected in third-party directories.

5.2 Right to Refuse Service

We reserve the right to refuse service to any individual for legitimate, non-discriminatory operational reasons applied consistently and uniformly to all customers, in compliance with California's Unruh Civil Rights Act (Civil Code §51). We do not refuse service on the basis of any characteristic protected by applicable law, including race, color, religion, sex, sexual orientation, gender identity or expression, national origin, disability, age, citizenship status, or marital status.


6. Disclaimer of Warranties

Website: The information on this Site is provided "as is" and "as available" for general informational purposes only. We make no representations or warranties regarding the accuracy, completeness, or timeliness of any information on this Site.

Products and Services: To the maximum extent permitted by California law, we disclaim all warranties, express or implied, for products and services offered at our store, including implied warranties of merchantability or fitness for a particular purpose. Our water products are produced and tested in compliance with applicable CDPH regulations. Packaged food, beverage, and supplement products are manufactured by third parties and are subject to those manufacturers' warranties and representations, if any.


7. Limitation of Liability

To the fullest extent permitted by applicable California law, LINH'S WATER & GENERAL STORE LLC's total liability to any customer for any claim — whether based in contract, tort, statute, or any other legal theory — arising from or related to any product purchased, service received, or visit to our store or Site, shall not exceed the amount actually paid by the customer for the specific product or service that is the direct subject of the claim.

In no event shall LINH'S WATER & GENERAL STORE LLC be liable for any indirect, incidental, consequential, punitive, or special damages, even if we have been advised of the possibility of such damages.

Nothing in this section limits liability for gross negligence, willful misconduct, or fraud, to the extent such limitation is prohibited by California law.


8. Indemnification

You agree to indemnify, defend, and hold harmless LINH'S WATER & GENERAL STORE LLC and its members, managers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our products or services; (b) your breach of these Terms; (c) your own negligence or willful misconduct; or (d) your violation of any applicable law or third-party right.


9. Website Accessibility

We are committed to making this Site accessible to all users. Our Site is designed with reference to WCAG 2.1 Level AA accessibility guidelines. If you encounter any accessibility barrier on our Site, please contact us at (310) 878-1156 and we will make reasonable efforts to assist you and address the issue.


10. Modifications to These Terms

LINH'S WATER & GENERAL STORE LLC reserves the right to modify these Terms at any time at our sole discretion. Changes take effect immediately upon posting to the Site, with the "Last Updated" date updated accordingly. Your continued use of the Site or our in-store services after any revision constitutes acceptance of the updated Terms.

For in-store customers, in-store operational policies are governed by signage posted within the physical location, which will be updated when material policy changes occur.


11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the validity and enforceability of all remaining provisions will not be affected.


12. No Waiver

Our failure to enforce any provision of these Terms on any occasion shall not constitute a waiver of our right to enforce that provision or any other provision on any future occasion.


13. Force Majeure

We are not liable for any delay or failure to provide products or services resulting from causes beyond our reasonable control, including utility or infrastructure failures, natural disasters, equipment failure due to unforeseen causes, supply chain disruptions, public health emergencies, government orders, or any other cause beyond our reasonable control.


14. Dispute Resolution

We encourage customers to contact us before initiating any formal legal action. Most concerns can be resolved by contacting us at (310) 878-1156. Either party may bring eligible claims in California small claims court without prior notice to the other party. Nothing in these Terms prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where circumstances warrant.


15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of those courts for such purposes.
